Refund Policy & Privacy Protocols

1. Educator Listing Subscriptions (Lemon Squeezy)

Because listing memberships provide immediate digital credentialing, database activation, and ongoing eligibility in the diagnostic matching pool:

Cancellation: Tutors may cancel recurring listing billing at any time without fees or penalties. Following cancellation, listing privileges remain active until the end of the paid billing cycle (week or month), after which no further charges occur.
Non-Refundable Renewals: Platform membership fees are non-refundable once billed. We do not issue partial or prorated refunds for mid-cycle cancellations.
Statutory Digital Exceptions (Kuwait Decree Law No. 10/2026 & ECTA Section 44): Under applicable consumer legislation, consumer withdrawal rights do not apply once digital platform performance has commenced with the subscriber’s explicit consent at checkout.
Billing Errors: In the event of duplicate billing or verifiable administrative errors, contact [email protected] within 14 days with your Lemon Squeezy Order ID for a prompt reversal.

2. Hourly Tutoring Fees

Because Apex Learning does not collect, manage, or take commission on hourly tuition fees, the Company does not hold instructional funds and cannot issue refunds for tutoring sessions.

All lesson billing, advance session bookings, 24-hour rescheduling policies, and lesson satisfaction terms are agreed upon directly between the parent/student and the educator.

3. Cross-Border Data Transfers (POPIA & Kuwait CITRA Compliance)

Apex Learning (Pty) Ltd (CIPC Registration: 2026 / 262544 / 07) complies with the South African Protection of Personal Information Act (POPIA No. 4 of 2013) and the regulatory standards of the Kuwait Communication and Information Technology Regulatory Authority (CITRA / Data Privacy & Protection Regulations).

Users in Kuwait explicitly acknowledge and consent to the transmission and hosting of diagnostic and administrative intake data on secured cloud infrastructure located outside the State of Kuwait (including Google Workspace / Google Apps Script cloud endpoints and Lemon Squeezy billing infrastructure) solely for matching operations, account authentication, and payment processing.

4. Blind Matching Protocol & Data Protection

No Public Classifieds Directory: To safeguard educator privacy and eliminate commercial bias, tutor profiles are not published on open, crawlable public boards.
Controlled Contact Disclosure: Student, parent, and tutor telephone numbers and email addresses are never distributed publicly. Contact information is only shared between the designated educator and family once both parties have formally confirmed match compatibility and agreed to hourly instructional rates through the matching desk.
No Commercial Data Sales: We do not sell, rent, or monetize personal information to third-party marketing brokers.

5. Data Subject Rights & Security

Users retain the right under POPIA and Kuwait DPPR regulations to request access to their records, demand corrections, or request complete profile erasure from our candidate registry at any time by contacting [email protected].

All platform communications utilize standard 256-bit SSL/TLS encryption.
